Seller
Works are sold by Marisa Viglione (Marisa V), artist, in Montréal. Her full contact details, including address and phone number, appear on the written confirmation you receive before any payment.
The works
Every original is one of a kind and made by hand. Photos are as faithful as possible; colours and the shine of metal leaf vary with the screen and the light. Dimensions preceded by “≈” are approximate and confirmed before the sale.
Prices
Prices are in Canadian dollars. Applicable taxes, framing and delivery are extra, unless stated otherwise. The total price, all charges included, is confirmed to you in writing before payment.
Reservation and payment
A reservation request is not binding. Before any payment, Marisa sends you a written proposal that states: her name, address, phone number and email; a detailed description of the work; the price of the work, the delivery charges and the taxes, each listed separately, and the total price; the delivery method, the carrier, and the place and date of delivery; the cancellation and return conditions. You can accept it, decline it or have an error corrected. She then sends you a secure card payment link; the work is reserved for you once payment is received, and a written copy of the contract reaches you within 15 days. At in-person pickup, Interac e-Transfer and cash are also accepted.
Delivery
Free pickup in Montréal, by appointment. Delivery in Québec and Canada, at a rate confirmed before payment. International delivery on request; import duties and taxes are paid by the buyer.
Returns
A shipped original may be returned within 14 days of delivery, in its original condition and packaging. The return is sent insured, at the buyer’s expense. The refund is made within 15 days of receiving the returned work. A work handed over in person is examined on the spot; the sale is then final.
Commissions
A commission starts when a 50% deposit is received by card. If you cancel along the way, Marisa keeps the part of the deposit that covers work done and costs incurred and refunds the rest; if the work is not delivered within 30 days of the agreed date, the deposit is refunded in full. The balance is due on approval of the work, before handover. One sketch and two minor adjustments are included. Once the work is approved, the sale is final. The written proposal sets out the subject, size, price and timing.
Prints
Prints are printed or finished to order. They cannot be returned or exchanged unless they arrive damaged; in that case, write to Marisa, ideally within 7 days, with a photo. Silkscreen impressions already printed follow the originals’ rule (returns within 14 days).
Copyright
Buying a work or a print does not transfer copyright. Marisa keeps the right to reproduce images of her work, including in her portfolio.
Your rights
You may cancel the contract within 7 days of receiving its copy if it lacks information required by law, or within 30 days of its conclusion if you received no copy. If the work is not delivered within 30 days of the agreed date (or, with no agreed date, of the conclusion of the contract), you may also cancel it. Marisa then refunds every amount paid, deposit included, within 15 days; if you paid by card and were not refunded, you can ask your card issuer to cancel the payment.
These terms in no way limit the rights and warranties you have under Québec’s Consumer Protection Act.
These terms are written in French. The English version is provided for information; if the two differ, the French version prevails. Your written confirmation and invoice are issued in French; at your express request, an English version is also provided.
